ตั้งใจปล่อย:โดยทั่วไปแล้ว “ตั้งใจปล่อย” มีความหมายเชื่อมโยงถึงหน้าที่การทำงานของผลิตภัณฑ์ ซึ่งหมายความว่า หากไม่มีการปล่อยสารเคมีนี้แล้ว ผลิตภัณฑ์จะไม่สามารถทำงานที่ต้องการได้ (ซึ่งโดยทั่วไปแล้ว ไม่ใช่หน้าที่หลักแต่เป็นฟังก์ชั่นเสริม) ตัวอย่างเช่น ผลิตภัณฑ์ที่มีกลิ่น – การจะทำให้ผลิตภัณฑ์มีกลิ่นได้ ต้องมีการปลดปล่อยสารให้กลิ่นให้ผู้ใช้สูดดม สารที่ปลดปล่อยออกมาเนื่องจากผลิตภัณฑ์ถูกใช้งานเป็นเวลานาน หรือเกิดจากการสึกหรอ หรือเป็นผลจากอุบัติเหตุ ไม่ถือเป็นการตั้งใจปล่อย เนื่องจากการปลดปล่อยลักษณะนี้ไม่ก่อให้เกิดประโยชน์ (ที่ผู้ผลิตมุ่งหวัง)

“As a general rule, ‘intended release’ relates to a function of an article. This means if the substance were not released, the respective function (which in most cases is not the main, but an accessory function) would not be achieved. In case of scented articles for example, the fragrance substances need to be inhaled in order for the article to be smelled. Substance which are released because of ageing of articles, because of wear and tear or as a result of accidents, are not intended releases, as the release as such does not provide a function in itself. Further explanation of the term intended release can be found in Appendix 1 of this guidance.”

สารต่อไปนี้ถือเป็นสารที่น่าเป็นห่วง

• สารที่ได้ตามเกณฑ์การแบ่งประเภทสารเคมีตามระเบียบ67/548/EEC ที่จัดเป็น:
  • สารก่อมะเร็ง ประเภท 1 หรือ 2
  • สารที่ก่อให้เกิดการกลายพันธุ์ ประเภท 1 หรือ 2
  • สารที่เป็นพิษต่อการสืบพันธุ์ ประเภท 1 หรือ 2
• สารที่เป็นสาร คงทน สะสมในสิ่งมีชีวิต และเป็นสารพิษ (PBT) หรือคงทนมากและสะสมในสิ่งมีชีวิตมาก (vPvB) ตามเกณฑ์ที่กำหนดไว้ใน Annex XIII ของกฎ REACH
• สารที่มีลักษณะสมบัติ ในการทำลายฮอร์โมน หรือสารที่มีลักษณะเป็นสารคงทน สะสมในสิ่งมีชีวิต และเป็นสารพิษ หรือสารที่มีลักษณะ คงทนมากและสะสมในสิ่งมีชีวิตมาก หรือสารที่มีลักษณะอื่นที่ก่อให้เกิดความเป็นห่วงในระดับเดียวกันกับสารที่กล่าวข้างต้น

สารที่น่าเป็นห่วงมาก ที่อาจเป็นส่งผลเสียร้ายแรงต่อชีิวิตมนุษย์หรือสิ่งแวดล้อม สารเหล่านี้อาจถูกเลือกให้เข้าไปอยู่ใน Annex XIV ของ REACH หรือเป็น Candidate List สำหรับการเลือกให้เข้าไปอยู่ใน Annex XIV

โดยหลักทั่วไป สารเคมีใดๆ ที่มีสารองค์ประกอบหลักมากกว่า 1 ชนิดที่มีส่วนผสมเกิน 10% โดยน้ำหนัก และไม่เกิน 80% โดยน้ำหนัก

สารเคมีที่ได้มีการยื่นจดแจ้งแล้ว และเป็นสารที่สามารถวางตลาดได้ตามข้อกำหนดของระเบียบ 67/548/EEC

องค์ประกอบที่ไม่ได้ตั้งใจที่มีอยู่ในสารเคมีที่ผลิต สารนี้อาจมาจากวัสดุตั้งต้น หรืออาจเป็นผลจากปฏิกิริยาลำดับที่สองหรือการทำปฏิกิริยาที่ไม่สมบูรณ์ในระหว่างกระบวนการผลิต แม้จะมีสารปนเปื้อนปรากฏอยู่ในสารเคมีขั้นสุดท้าย แต่ไม่ได้เป็นการตั้งใจใส่

ธาตุหรือสารประกอบทางเคมี ทั้งที่เกิดเองตามธรรมชาติ หรือที่ได้มาจากกระบวนการผลิต ทั้งนี้หมายรวมถึง สารเติมแต่ง ที่จำเป็นต้องใช้เพื่อให้ สสารหรือสารเคมีนั้นๆ คงสภาพอยู่ได้ และสารปนเปื้อนที่ติดมาจากกระบวนการผลิตที่ใช้ แต่ไม่รวมถึงตัวทำละลาย  ที่สามารถแยกออกจาก "วัตถุ" นี้ได้โดยไม่ส่งผลต่อเสถียรภาพหรือส่วนผสมของ "วัตถุ" ชนิดนี้
